Once Miguel Bustamante was spotted emptying Clifford Lambert's home, he implicated the other men, prosecutors report. He's charged with first-degree murder, conspiracy and committing a murder during a burglary and for financial gain. In fact, Riverside County District Attorney Rod Pacheco has charged all of the gang but Manning with murder. That the murder was committed during a burglary means that the five men accused of murder are eligible for the death penalty, which prosecutors are not currently pursuing.

Craig McCarthy is charged with theft and murder.

Detectives caught Daniel Garcia in San Diego when he used Lambert's debit card in mid-January. His attorney, Mario Rodriguez, says that Lambert had offered to let Garcia take money from his account, which would make the $13,000 he allegedly took from Lambert's account after his disappearance just a gift. Garcia is charged with grand theft and forgery, murder while committing a felony and murder for financial gain.

Russell Herbert Manning is accused of fraud relating to the attempted sale of Lambert's house and transfer of money out of Lambert's Pacific Western Bank account.

Palm Springs Police Detective Simon Min says that it was David Replogle's fingerprint that notarized the power of attorney. He alleges that on December 11 and 12, a total of $210,509 was wired from Lambert's accounts to Niroula's.

Kaushal Niroula is charged with forgery, burglary, and four counts of grand theft, murder while committing a felony, and murder for financial gain,

Each of the men is being held on $5 million bail, and all of them have pleaded not guilty. Kaushal Niroula's saucy smile and seductive stories might not get him out of this one.
